1.      What Types of information does Montana Homefitters Fine Furniture collect from me? 

 

Montana Homefitters Fine Furniture gathers two basic types of information through the Site: "Personal Information" (or "PI") and "Non-Personal Information" (or "Non-PI"). Personal Information is information that identifies you as an individual; that is, your name, postal address, telephone number, e mail address or your credit card number. Non-Personal Information is aggregated information, demographic information, IP addresses and any other information that does not reveal your specific identity.

 

a.       Personal Information.  You do not have to provide us PI in order to use the Site. In order for you to benefit from the opportunities that the Site offers, we may require you supply PI.  We collect PI only when you voluntary provide it to us.    

 

b.      Non-Personal Information.  When you visit and interact with the Site, Montana Homefitters Fine Furniture and third parties with whom Montana Homefitters Fine Furniture has contacted to provide services may collect Non-PI.  Non-PI is generally collected from four different sources: server log files, cookies, pixel tags, and other similar technologies and information that you voluntary provide.

 

 

                                                                                       i.      Server Log Files. Your Internet Protocol (IP) address is an identifying number that is automatically assigned to your computer by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. We use your IP address, and the IP addresses of all users, to calculate Site usage levels, to help diagnose problems with the Site's servers, and to administer the Site. Collecting IP addresses is standard practice on the Internet and is done automatically by many web sites.

 

                                                                                     ii.      Cookies. We and our service providers may use "cookies" on the Site. Cookies are data that a web server transfers to an individual's computer for recordkeeping purposes. Cookies are an industry standard used by most web sites, and can facilitate users' ongoing access to and use of a particular web site. Cookies do not cause damage to your computer systems or files, and only the web site that transferred a particular cookie can read, modify or delete such cookie. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular web site, to your computer.

 

 

                                                                                    iii.      Pixel Tags. We and our service providers may also use so-called "pixel tags," "web beacons," "clear GIFs" or similar means (collectively, "Pixel Tags") in connection with some Site pages and HTML-formatted e-mail messages to, among other things, compile aggregate statistics about Site usage and response rates. A Pixel Tag is an electronic image, often a single-pixel (1x1), that is ordinarily not visible to Site visitors and may be associated with Cookies on the visitors hard drives. Pixel Tags allow us to count users who have visited certain pages of the Site, to deliver branded services, and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML-formatted e-mail messages, Pixel Tags can tell the sender whether and when the e-mail has been opened.

 

                                                                                   iv.      Information That You Voluntarily Provide. Montana Homefitters Fine Furniture also collects Non-PII (e.g., your interests, your geographic location, etc.) when you voluntarily provide such information to us.

 

 

2.      How does Montana Homefitters Fine Furniture use the information collected on the site?

To the extent that Payment Information includes Non-PI, use of such Non-PI is governed by Section 2.b below.

 

We may operate sweepstakes, contests, raffles and similar promotions through the Site. We typically ask you for certain PI when you enter and, if applicable, win a sweepstakes, contest, raffle or similar promotion. We reserve the right to share this PI with third parties sponsors of such sweepstakes, contests, raffles and promotions, or otherwise in accordance with the rules applicable to such sweepstakes, contest, raffle or promotion. You should carefully review the rules of each sweepstakes, contest, raffle and promotion in which you participate through the Site, as they may contain additional important information about Montana Homefitters Fine Furniture's  or a sponsor's use of your PI. To the extent that the terms and conditions of such rules concerning the treatment of your PI conflict with this Policy, the terms and conditions of such rules shall control.

Finally, notwithstanding any other provision of this Policy to the contrary, we reserve the right to disclose your PI if we believe that we are required to do so (a) by law; (b) to comply with legal process or governmental requests; (c) to enforce our Terms and Conditions; (d) to protect our operations or those of any Affiliated Entities; (e) to protect the rights, privacy, safety or property of Montana Homefitters Fine Furniture, the Affiliated Entities, you or others; and (f) to permit us to pursue available remedies or limit the damages that we may sustain. For example, we may, to the fullest extent the law allows, disclose PI about you to law enforcement agencies to assist them in identifying individuals who have been or may be engaged in unlawful activities.

 

b.      Non-Personal Information. Because Non-PI does not personally identify you, we may use such information for any purpose. In addition, we reserve the right to share such Non-PI, which does not personally identify you, with Affiliated Entities and other third parties, for any purpose.

 

In some instances, we may combine Non-PI with PI. If we do combine any Non-PI with PI, the component of the combined information that consists of your PI will continue to be governed in accordance with the provisions of this Policy concerning our use of your PI (see 2.a above).

 

3.      Other important notes regarding our privacy practices. 

 

a.       Third Party Service Providers. We work with third parties who provide services including but not limited to data analysis, order fulfillment and other services of an administrative nature. We reserve the right to share your PI with such third parties solely for the purpose of enabling such third parties to provide such services.

 

b.      Security. We have security measures and tools, such as firewalls, in place to help protect against the loss, misuse and alteration of the information under our control. Additionally, any time you provide us with your credit card number, that credit card number is transmitted to us by your browser in an encrypted format using industry-standard, SSL (secure socket layer) encryption. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, although we strive to protect your PI, we cannot ensure or warrant the security of any information you transmit to us through or in connection with the Site. No method of transmitting or storing data is completely secure. You acknowledge and agree that any information you transmit through the Site is so transmitted at your own risk. If you have reason to believe that your interaction with us is no longer secure, you must immediately notify us of the problem by contacting us in accordance with "Contacting Us," below.

 

c.       Third Party Sites. The Site may contain links to third party web sites. These linked sites are not under Montana Homefitters Fine Furniture's control and we are not responsible for the privacy practices or the contents of any such linked site, or any link contained in any linked site. We provide such links only as a convenience, and the inclusion of a link on the Site does not imply endorsement of the linked site by Montana Homefitters Fine Furniture or any Affiliated Entities. d.      Opt-Out. We may from time to time send you e-mail marketing messages about products and services which we believe would be of interest to you, and we may share your PI with third parties to allow such third parties to contact you about products and services which they believe would be of interest to you. If you would prefer not to receive such marketing messages from us, or if you would prefer that we do not share your information with third parties for their marketing purposes, you may opt-out from such marketing uses or such third party disclosures at anytime by contacting us by e-mail at customerservice@homefitters.net. In addition, you may also unsubscribe from receiving such marketing messages from us by clicking on the "unsubscribe" link at the bottom of such messages.

 

Please note, however, that if you opt-out, we will not be able to remove your PI from the databases of third parties with whom we have shared your PI before processing your opt-out request. If you wish to cease receiving marketing messages from such third parties, you will need to contact them directly or utilize the opt-out mechanisms set forth in their privacy policies or marketing messages.

 

e.       Changing or Removing Your PI. We provide you with several options for reviewing, correcting, updating or otherwise modifying PI that you have previously provided through the Site:
1. You may log into your account, and make changes to your account profile.
2. You may contact us by e-mail at customerservice@homefitters.net

 

In each event, you must clearly indicate the information that you wish to have changed, or clearly indicate that you wish to have your PI removed from our database. We will endeavor to comply with your request as soon as reasonably practicable. However, we may need to retain certain information for recordkeeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed therefrom. We also reserve the right, from time to time, to re-contact former users of the Site. Finally, we are not responsible for removing information from the databases of third parties with whom we have already shared your PI.

 

f.        Assignment. We reserve the right to transfer any and all information that we collect from users of the Site to a third party in the event of any merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Montana Homefitters Fine Furniture business, assets or stock.
